Terms of use

Who we are

Peakd Developers is a product studio. These terms cover the public site, the authenticated studio OS, Scalr, and applications we build or operate that message people.

The site and the OS

The public pages describe the studio. The authenticated product (the OS) and Scalr are working systems for running that work, including messages and Meta connections a customer directs. Using them means you accept these terms.

Accounts

Public signups are client accounts. Staff join only through an invite. You can also sign in with Google. You are responsible for the credentials on your account and for activity under it.

Acceptable use

Use the OS for legitimate studio and client work. Do not attempt to access other tenants’ data, disrupt the service, or use it to send unlawful or deceptive communications. We may suspend an account that breaks this rule. Messaging and Meta connections are also covered by the sections below.

Text messages from Peakd

If you give us a mobile number and opt in, you agree to receive texts from Peakd. Account and service texts cover invites, security, and delivery of something you asked us to do. Promotional texts are a separate opt-in. Promotional consent is optional and is not required to buy services from us.

You confirm the number is yours and that you are allowed to receive texts at it. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of that program. Reply HELP for help, or email contact@peak-d.com.

Participating carriers are not liable for delayed or undelivered messages.

Messaging for customers

If you use Scalr or another application we operate to text your users, you are the message sender. You decide the audience, the content, and the program name. The message must identify your brand so the recipient knows who is texting them.

You must have prior express consent that names texting specifically. Where the law requires written consent, you must have that. Consent to email or to a phone call is not consent to a text. You must keep records of that consent. You must honor STOP and HELP. You must not use these tools for unlawful or deceptive content.

You are responsible for claims arising from messages you direct. We may suspend messaging that puts our carrier registration, our Meta access, or other customers at risk.

Meta

Connecting Facebook, Instagram, Meta ads, WhatsApp, or Messenger authorizes us to use those APIs only for your purpose: the posts, ads, and messages you direct, and the account connection you asked for.

You must follow Meta’s Platform Terms, Developer Policies, and the product terms that apply, including the WhatsApp Business Policy and the Marketing API rules. You must not ask us to sell Meta platform data, use it for surveillance, use it for eligibility decisions about housing, employment, credit, insurance, education, government benefits, or immigration, or collect a Meta password.

Business-initiated WhatsApp, Messenger, and Instagram messages require the consent Meta and the law require. You must obtain that consent before we send. You must show your own privacy policy to your end users.

We keep each customer’s Meta data separate. We delete it when you or your user asks, or when the account ends, unless the law requires us to keep it. We may disconnect you when Meta requires it.

Client work and IP

Work Peakd Developers builds for a client under a separate engagement belongs to that client as the engagement says. The OS, Scalr, and our public site remain Peakd Developers property. You keep the records you enter; you do not get a license to copy the product.

Invoices and payment

Invoices in the OS are records of work. They are not, by themselves, a payment processor. Amounts, due dates, and payment terms follow the proposal or invoice we issue, or the written agreement for that job.

Disclaimer

The public site and the OS are provided as they stand. We aim for calm, reliable delivery. We do not warrant that the service will be uninterrupted, error-free, or fit for a purpose we have not agreed in writing.

Limitation of liability

To the extent the law allows, Peakd Developers is not liable for indirect, incidental, or consequential loss, or for lost profits, data, or goodwill arising from the site or the OS. Direct liability is limited to the fees paid to us for the engagement that gave rise to the claim in the twelve months before it.

Suspending messaging or a Meta connection to meet carrier rules, Meta’s terms, or this agreement is not a breach of these terms.

Changes

We may update these terms. The date at the top is the current version. Continued use after a change means you accept the new terms.
